1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 593/2025 registered at Police Station-Mohan Nagar, District - Durg (C.G.) for the offence punishable under Sections 317(2), 317(4), 318(4), 111, 3(5) of Bhartiya Nyay Sanhita, 2023.
2. Case of the prosecution, in brief, is that as per FIR Mohan Nagar police station has received information that 22 account holder of Bank of Karnataka has used their account and received the amount VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.05.12 15:26:48 +0530
2 from cyber fraud. Acting upon the information the police have collected the detail of those account holders from concern bank and it surfaced that the mule accounts have been used in promoting the cyber economic fraud. That accounts of 22 out one account No. 2042500101375401 was opened in the name of applicant hence the applicant was called by the police and arrested on 06.11.2025. the copy of FIR No. 593/2025 is filed here with as Annexure A-3.

It is argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in crime in question and there is no previous criminal antecedent against the present applicant. He further submits that in memorandum statement that one person under enticed him to open an account for which he would be paid only 5,000/- and as he less educated up 8th slandered carrying out his lively hood from driving profession he could not understand the mischievous scheme and under the greed to get Rs.5,000/- followed his instructions and got open bank account in aforesaid bank. He further contended that charge-sheet has already been filed in the present case, the applicant is in jail since 06.11.2025 and the conclusion of trial is likely to take some time, therefore, she prays for releasing the applicant on regular bail.
4. On the other hand, learned State counsel opposes the bail application and submits that there is one complaint regarding 50,000 has also ₹
been filed against the applicant and the charge-sheet has been filed in this case. He further submit that in compliance of the Court’s
order dated 09/04/2026, the Superintendent of Police has filed his personal affidavit. 5. I have heard learned counsel for the parties and perused the case diary. 3
6. In compliance of the Court’s order dated 09/04/2026, the Investigating Officer, Durg has filed his personal affidavit and relevant paragraphs of the affidavit reads as under:-

That, thereafter, during investigation, the present accused applicant/aforesaid mule bank account holder was summoned and questioned and his memorandum statements was taken infront of the relevant witnesses wherein he has categorically deposed that, by alluring one unknown person to give Rs. 5000/- for providing his bank account, the present accused applicant has got opened his aforesaid bank account and has handed over to the said unknown person in which, the said unknown person has installed his personal SIM, but the said unknown person has not given any money for the same to the present accused applicant. 9.That, during investigation, it was found that, a total amount of Rs. 52,81,736/- has been credited in the aforesaid Karnataka Bank Account Number of the present accused Applicant during the short span of time period since its opening from 06.01.2024 till the investigation and a total amount of Rs. 52,36,251/- has been withdrawn/debited from the aforesaid Bank Account by the accused person. 7. Considering the facts and circumstances of the case, submissions made by learned counsel for the party, allegation levelled against the present and involvement of present applicant, further considering the affidavit filed by the Investigating Officer, wherein it is mentioned that during investigation, it was found that, a total amount of Rs. 52,81,736/- has been credited in the aforesaid Karnataka Bank Account Number of the present accused Applicant during the short span of time period since its opening from 06.01.2024 till the investigation and a total amount of Rs. 52,36,251/- has been withdrawn/debited from the aforesaid Bank Account by the accused person, therefore, this Court does not find it to be a fit case to release
4 the applicants on regular bail. 8. Accordingly, the bail application of the applicant- Kalvinder Singh, involved in Crime No.593/2025 registered at Police Station Mohan Nagar, District - Durg (C.G.) for the offence punishable under Sections 317(2), 317(4), 318(4), 111, 3(5) of Bhartiya Nyay Sanhita, 2023, is rejected at this stage. 9.
Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
