Deepak Ji @ Deepak Yadav @ Karan Yadav @ Karu Yadav @ Deepak, son of Hulas Yadav, aged about 48 years, Village – Dodhwa, PO & PS – Katkamsandi, District – Hazaribagh. … … …Petitioner Versus The State of Jharkhand. … … …Opp. Party ------
HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Ms. Divya, Advocate For the State
: Mr. Manoj Kr. Mishra, Addl. P.P. ------
Order No:- 05, Dated:- 09th July, 2026
Heard the parties. The petitioner has moved before this Court for grant of bail in connection with Pathalgadda P.S. Case No. 38 of 2009, S.T. Case No. 117 of 2025, registered for the offences punishable under sections 147, 148, 149, 323, 506, 364, 302 the Indian Penal Code along with Section 17(1)(2) of the C.L.A. Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was a member of an unlawful assembly and being armed with deadly weapons, committed murder of the husband of the informant, namely, Hira Turi and the petitioner is one of the members of MCC extremists Organization. It is further submitted that the allegations against the petitioner are all false and the co-accused who has faced the trial, has been acquitted. It is then submitted that the petitioner has been in custody since 18.03.2025, as has been mentioned in paragraph no. 08 of the bail application. It is next submitted that no witness has been examined though charge-sheet has been submitted. It is lastly submitted that the petitioner is ready and willing to cooperate with the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail of the petitioner
and submits that keeping in view the serious nature of direct allegation against the petitioner as well as of his criminal antecedent, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not be admitted to bail.
Considering the serious nature of allegation against the petitioner and the chance of the petitioner absconding and tampering with the evidence, if released on bail, this Court is of the considered view that this is not a fit case where the petitioner be admitted to bail. Accordingly, the prayer for bail of the petitioner is rejected. (Anil Kumar Choudhary, J.) Dated – 09.07.2026 Aditi
