This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicants, who are apprehending their arrest in connection with Crime No.25/2026 registered at Police Station – Sanna District - Jashpur (C.G.) for the offence punishable under Sections 296, 351(2), 115(2), 3(5), 309(4) and 331(6) of BNS, 2023.

According to prosecution story, on 04.03.2026, the complainant namely Kalpana Bhagat W/o Santosh Bhagat, lodged a report alleging that while she was threshing paddy in the kitchen and her husband Santosh Bhagat was sleeping in his room, the Applicants along with other co-accused persons, arrived at their house in a Bolero vehicle, abused and threatened Santosh Bhagat with dire consequences. It is alleged that Applicant No. 2, armed with a danda, along with the other accused persons, assaulted Santosh Bhagat by hands, fists and danda, causing injuries to his face, nose, ear, head and chest. It is further alleged that when one Devmati objected, Applicant No. 2 slapped her and snatched her mobile phone. Based on the aforesaid allegations, the offences as mentioned above have been registered against the present Applicants. Hence, this application.

Learned counsel for the Applicants submits that the Applicants are innocent and have been falsely implicated in the present case. It is contended that that Applicant No. 1- Shrinath Sahni, being a handicapped person, has been falsely implicated due to a complaint filed by him under Section 175(3) BNSS regarding fraudulent inclusion of names in the 2002 Survey List. Lastly, it is submitted that trial is likely to take considerable time for its conclusion, therefore, the present Applicants may be extended the benefit of anticipatory bail.

Learned Counsel for the State opposed the prayer for anticipatory bail and submitted that the present Applicants are having one criminal antecedent, however, she fairly admits that the nature of injury sustained by the injured is simple in nature.

Having heard learned Counsel for the parties, having considered the facts and circumstances of the case, particularly considering that the nature of injuries sustained by the victim is simple in nature and the trial may take quite some time for its conclusion, this Court is inclined to allow the anticipatory bail application.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicants – Shrinath Sahni and Deepak Sahni, on executing a personal bond and one surety each in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her/him/them from disclosing such fact to the Court. (b) The applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant/s shall appear before the trial Court on each and every date given to her/him/them by the said Court till disposal of the trial. (d) The applicant/s and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant/s shall not involve herself/himself/themselves in any offence of similar nature in future. Sd/-
