Shajada @ Rohit … Petitioner(s) Mr. Sk Toslim Ali … for the Petitioner(s) Mr. Partha Pratim Das Ms. Sana Naaz … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year eight months and from the month of May, 2025, no witnesses are being produced by the prosecution. Learned advocate for the State, on the other hand, submits that there is heinousness attached to murder of the deceased. It has been informed that 12 witnesses have already been examined by the prosecution and, presently, the prosecution intends to examine three more witnesses. Considering the gravity of the offence and the fact that the prosecution has taken a decision to reduce the number of witnesses, last opportunity is granted to the 2 prosecution so that remaining three witnesses are completed within three months, thereafter, Section 313 of the Cr.P.C. be completed and the learned trial court would put in efforts so that by 31st July, 2026 the verdict is pronounced by the learned trial court. Having regard to the totality of the circumstances, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is rejected.
