This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Raghunathpali PS Case No.395 of 2023 corresponding to Special GR Case No.125 of 2023 pending in the file of Addl. District and Sessions Judge(FTSC)(POCSO), Rourkela for commission of offences punishable U/Ss. 376(AB)/307 of the IPC r/w Section 6 of the POCSO Act, on the main allegation of committing rape and aggravated penetrative sexual assault upon the victim aged about less than 12 years. 3. Heard, Mr. Soumya Ranjan Das, learned counsel for the Petitioner and Mr. C. Mahanty, learned Addl. PP in the matter and perused the record together with the evidence of the victim. None appears for the victim despite being duly informed as apprised by learned Addl. PP. p. 2 4. After having considered the rival submission and on going through the materials placed on record keeping in view the evidence of the witnesses so far examined, more particularly that of the victim; this Court is not inclined to grant bail to the Petitioner. 5. Hence, the bail application of the petitioner stands rejected. In view of the alternative oral prayer as advanced for the Petitioner, trial be expedited, if there is no other legal impediment. 6.
