THE STATION HOUSE OFFICER, TOWN POLICE STATION, KADAPA KADAPA DISTRICT ...RESPONDENT(S): Counsel for the Petitioner: BHASKAR PREM KOUSHIK Counsel for the Respondent(S): 2 Dr. YLR, J W.P.No.10355 of 2026 Dated 04.05.2026 GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in not considering the representation dt 16. 12. 2025 of the petitioner seeking change of the Investigating Officer in Crime No. 308/2025 dated 10.12. 2025 on the file of I Town Police Station Kadapa as illegal arbitrary and violative of Articles 14 and 21 of the Constitution of India particularly in view of the fact that the present Investigating Officer is closely associated with the accused persons and is attempting to shield the real offenders and falsely implicate other persons and consequently direct the respondents to consider and dispose of the said representation by appointing an independent fair and impartial Investigating Officer or in the alternative to transfer the investigation to an independent agency and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Mr. Bhaskar Prem Koushik, learned counsel for the petitioner, submits that the petitioner submitted a representation dated 16.12.2025 to the Superintendent of Police seeking change of the Investigating Officer in the matter. The said representation submitted to respondent No.3 has not been considered, despite lapse of more than four months. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the investigation is being conducted in an effective and efficient manner. 3 Dr. YLR, J W.P.No.10355 of 2026 Dated 04.05.2026 5. Be that as it may, when the petitioner submits a representation to respondent No.3, it is the duty of respondent No.3 to dispose of the same in accordance with law. 6. Having regard to the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the respondent No.3 to dispose of the representation dated 16.12.2025 submitted by the petitioner, in accordance with law, within a period of three (03) weeks from the date of receipt of the copy of this order. 7.
