Heard Sri. M. Arun Shyam, learned Senior counsel along with Sri. Suyog Herele E., learned counsel appearing for the petitioner; Sri. B.N. Jagadeesha, learned Additional Special Public Prosecutor appearing for respondent No.1 and Sri. B. Roopesha, learned counsel appearing for respondent No.2.

2. This Court on 22.10.2024 had passed the following
order:
"Heard the learned Senior counsel, Sri. Aruna Shyam appearing for the petitioner.
Learned Addl.SPP waives notice for respondent No.1.
Issue emergent notice to respondent No.2.
The petitioner is before this Court calling in question the registration of a crime in Crime No.84/2024 registered for offences punishable under Sections 376(1), 354D, 354A, 354C, 448, 504, 506 read with Section 34 of the IPC.
Learned Senior counsel appearing for the petitioner taking this Court through the documents appended to the petition would seek to demonstrate that initially the crime was registered for offences punishable under Sections 354A, 354C and 450 of the IPC inter alia, later offence of Section 376 of the IPC is also emerged.
The respondent is said to be the client of the petitioner. There are proceedings instituted by the petitioner against the respondent No.2 for extortion and the husband of the complainant sought to initiate proceedings invoking the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the petitioner, which also ended in a 'B' report.
To all these proceedings, the impugned crime is registered as a counterblast, is what the senior counsel would seek to project.
Learned Addl.SPP submits that records would be secured as the FSL report is yet to come with regard to the images in the mobile phone.
The matter would require consideration and perusal of the records.

The petitioner shall co-operate with the investigation.
In the light of the aforesaid reasons, respondent No.1 - State shall not file a final report without the leave of the Court."
The final report was directed not to be filed without the leave of the Court. Therefore, the learned Additional Special Public Prosecutor submits though the final report was ready to be filed, it is not filed because of the interim order and they have preferred an application seeking vacation of the interim
order.
3. The learned Senior counsel would submit that he will reserve liberty to challenge the charge sheet so to be filed before the concerned Court.
4. In the light of the said submission, I deem it appropriate to dispose the subject petition, reserving liberty to the petitioner to knock at the doors of this Court, raising a challenge to the charge sheet and also grant permission to the State to file the final report before the concerned Court without brooking any further delay.

5. With the aforesaid observation, the petition stands
disposed.
