JUSTICE PRAMIL KUMAR MATHUR Order 20/01/2026 1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.166/2025 registered at Police [2026:RJ-JP:2428] (2 of 3) [CRLMB-15023/2025] Station-Manak Chowk, District-Jaipur City (North) for the offences under Sections 305(e) and 331(4) of BNS. 2. Since both the bail applications have arisen from common FIR, hence, they are being decided by this single order. 3. Heard learned counsel for the petitioners, learned Public Prosecutor and counsel for the complainant and perused the material available on record. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submits that the allegation against the present petitioners pertains to the alleged commission of theft of ornaments from the shop of the complainant. He submits that the co-accused, namely Dheeraj Kumar Meena, has been enlarged on bail by this Court vide order dated 21.11.2025, and the other co-accused, namely Vishram @ Jagdish Gujar and Kamal Gurjar, have been enlarged on bail by this Court vide order dated 03.12.2025. The case of the present petitioners stands on the same footing as that of the said co- accused. No custodial interrogation of the present petitioners is required. Though two cases are reported against petitioner Sandeep Singh but in both the cases petitioner Sandeep Singh has been granted bail. No criminal case is reported against petitioner Anil Kumar Choursiya. Petitioner Sandeep Singh is behind the bars since 15.10.2025, and petitioner Anil Kumar Choursiya is behind the bars since 12.10.2025 and has no criminal antecedents. The trial of the cases may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence on the ground of parity, the bail applications of the petitioners may be allowed. [2026:RJ-JP:2428] (3 of 3) [CRLMB-15023/2025] 5. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail applications. 6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the Sandeep Singh S/o Pratap Singh and Anil Kumar Choursiya S/o Shri Basantlal shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
