Khan For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 08/01/2026
1. The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused- petitioner has been arrested in connection with FIR No. 332/2025 registered at Police Station Mundawar, District Khairthal-Tijara for the offences under Sections 308(2), 308(6) and 61(2)(a) of BNS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the first bail application of the accused- petitioner was dismissed on 09.09.2025, thereafter, the prosecution has examined PW-1 Omprakash and he has not supported the prosecution story and denied the fact that any money was given by the complainant to the present petitioner. It is also contended that PW-2 complainant-Rampath has also been examined. The other similarly placed co-accused Bhupender has
[2026:RJ-JP:522] (2 of 3) [CRLMB-14218/2025] been enlarged on bail by the co-ordinate Bench and the case of the petitioner is not distinguishable from the other co-accused. It is also contended that the petitioner is in custody since 09.07.2025 and the matter is exclusively triable by Magistrate, therefore, on the grounds of long incarceration, the second bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the second bail application and contended that the petitioner's first bail application was dismissed by this Court on merits and there are no change in circumstances, therefore, he shall not be entitled for bail. It is also contended that the petitioner is a habitual offender and against him 4 cases under various provisions of IPC were registered, therefore, the second bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case and about the probative value of the complainant who has already been examined as PW-2. Considering the fact that the other co-accused Bhupender has already been enlarged on bail by the co-ordinate Bench and the matter is exclusively triable by Magistrate, the accused-petitioner is in custody since 09.07.2025 and further trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Dinesh Kumar S/o Shri Babulal Gurjar, in connection with FIR No. 332/2025 registered at Police Station Mundawar, District Khairthal- Tijara, shall be enlarged on bail provided he furnishes a personal
[2026:RJ-JP:522] (3 of 3) [CRLMB-14218/2025] bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so. 7. The accused-petitioner is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station is directed to maintain a regular register marking the presence of the accused-petitioner and shall send the presence report of the accused-petitioner on the same day to the concerned Trial Court without any delay. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
