DATED: 14 OCTOBER 2026 PC:- 1. Heard Mr. Dhongade, learned Counsel appearing for the Petitioners and Mr. Zummerwala, learned Counsel appearing for Respondent Nos.2 and 3. 2. After arguing the matter for some time, Mr. Dhongade, learned Counsel for the Petitioners, on instructions, states that the Page 1 Arjun 28-WP-2252-2026 & SR NO 29.DOC Petitioners will withdraw the Writ Petitions. However, he points out certain observations made in the impugned Order dated 27th March 2026 passed by the learned Additional Sessions Judge, Belapur, Navi Mumbai in Criminal Revision Application No.141 of 2023 and Criminal Revision Application No.142 of 2023. 3. However, it is required to be noted that the challenge in the said Criminal Revision Applications was to the orders issuing process. 4. Thus, it is clear that, the observations made in the impugned Order are prima facie observations. Needless to observe, the learned Trial Court shall not be influenced by the said observations. 5. Accordingly, the Writ Petitions are allowed to be withdrawn and dismissed as such, subject to above. [MADHAV J. JAMDAR, J.] Page 2 Arjun
