Heard learned counsel for the parties.

The instant writ application has been preferred by the petitioners praying therein for the following reliefs: i. For direction for payment of death-cum retirement benefits i.e. Gratuity, Leave encashment, G.P.F., Provisional pension, Full and final pension, Benefits of A.C.P. and all other Death-cum-retiral benefits with the interest and

For direction upon the respondents to consider on the ground of compassionate appointment of the Petitioners or one seat may be kept reserved in the roaster and after completion of the 18 years of age the Petitioner No.-2 or 3 may be considered for appointment on the compassionate ground in the place of Late Dharmendra Nonia who was working on the post of Cat.-1, F.B. No.-5676 & P.L.S. No.-14509731, C.M.P.F. A/c No.-RMF/36-5013, Rajhara Area.

Learned counsel for the petitioners submits that though the petitioners are fully entitled for the prayer made in the instant writ application; however, in spite of repeated representations the grievance of the petitioners has not been redressed.

Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such the petitioners may be directed to approach the concerned respondent by filing a fresh representation, who shall look into the matter so that the grievance of the petitioners can be redressed.

Having regard to the aforesaid submissions and without going into the merits of the case, the instant writ application is hereby disposed of by directing the respondent No.2 to look into the grievance of the petitioners by treating this writ application as representation and take a decision in the matter in accordance with law and applicable rules and regulations by passing a reasoned and speaking order within a period of 12 weeks from the date of receipt of copy of this order and communicate the same to the petitioners and if the decision is passed in favour of the petitioners, all consequential benefits shall be paid to them within a further period of 4 weeks.

One of the petitioners shall serve a copy of this writ

With the aforesaid observations and directions, the instant writ application stands disposed of. Pending I.A., if any, also stands closed.
