( 2026:JHHC:20345 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 6371 of 2026 ------ 1. Prakash Rai, aged about 26 years, s/o Feku Rai 2. Pratap Kumar Rai, aged about 24 years, s/o Feku Rai, Both resident of Village-Bafartola, P.O.-Maharajpur, P.S.- Taljhari, Dist.-Sahibganj, Jharkhand … Petitioners Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioners : Ms. Saba Ali, Advocate For the State : Mr. Ajay Kr. Pathak, Addl. P.P. ------ Order No.02 Dated- 09.07.2026 Heard the parties. The petitioners have moved this Court for grant of bail in connection with Taljhari P.S. Case No.229 of 2025 registered for the offences punishable under sections 316(2)/ 316(5)/ 318(4)/ 320/ 340(1)/ 336/ 60/340(2)/346/115(2)/126(2)/351(2)/3(5) of the B.N.S., 2023. The learned counsel for the petitioners submits that the allegation against the petitioners is that the father of the petitioners has taken Rs. 5,20,000/- for selling the land to the father-in-law of the informant and gave the possession of the land to him. After the death of the father-in-law of the informant, when the informant went to the place of land concerned with labourers, the petitioners along with their father and mother armed with deadly weapons abused and assaulted the informant. It is further submitted that the allegations against the petitioners are all false and the co-accused- the mother of the petitioners has been given the privilege of anticipatory bail vide order dated 15.04.2026 in A.B.A. No. 1631 of 2026 but as by that time, the petitioners were arrested and were in custody, so the anticipatory bail application of the petitioners were rejected as not pressed. It is next submitted that the dispute between the parties is basically a civil dispute and though charge sheet has been submitted in this case but no witnesses have been examined as yet. It is then submitted that the petitioners have been in custody since 06.04.2026, as has been mentioned in paragraph no. 01 of the bail application. It is next submitted that the petitioners undertake to cooperate with the trial of the case and further undertake that they will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioners be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioners on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Rajmahal, in connection with Taljhari P.S. Case No.229 of 2025 with the condition that the petitioners will cooperate with the trial of the case and will furnish their mobile numbers and a copy of their Aadhar Cards in the court below with the undertaking that they will not change their mobile numbers during the trial of the case, with further condition that they will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
