The petitioner is before this Court seeking for the following reliefs; a) Issue a writ of Certiorari or such other/writ quashing the tender notification dated 03.03.2026 bearing RFP No. DOT/DO/Moo/09/2024-25 for ‘Selection of Adventure Sports Operator for Operation of Water Sports, Adventure Sports and Tourism Activities at Krishna Raja Sagara Dam Backwaters, Mandya’ produced at Annexure-C b) Pass such other orders as this Hon’ble Court deems fit to grant in the interest of justice and equity. 2. The grievance of the petitioner is that the tender published by respondent No.2 on 27.02.2026 indicating the starting date to be 28.02.2026 and last date for submission to be 09.03.2026 is contrary to the Karnataka Transparency in Public Procurements Act, 1999 (for short “the KTPP Act’) inasmuch as the time period is less than the minimum required 15 days’ time prescribed thereunder. - 3 - HC-KAR NC: 2026:KHC:26443 WP No. 10220 of 2026 3. His submission is that the time period being lesser than the minimum required, the tender is void ab initio and is required to be cancelled. 4. Learned AGA submits that the time period which had been fixed has been extended from time to time, initially from 09.03.2026 to 24.03.2026 and thereafter from 24.03.2026 to 26.03.2026 and from 26.03.2026 to 31.03.2026. The petitioner has submitted his tender documents, the documents would be considered as per the tender notification, the petitioner cannot have any grievance with the same. 5. Having perused the records, it is clear that the only grievance that the petitioner has is that time period which had been fixed was lesser than the minimum period of 15 days. This could have been considered by this Court, if the petitioner had not submitted his tender and was prevented from doing so, due to a - 4 - HC-KAR NC: 2026:KHC:26443 WP No. 10220 of 2026 truncated time period being provided on tender notification. 6. Admittedly, the petitioner has submitted his tender documents, and those documents would be considered by the respondent at the relevant point of time. There is no prejudice which has been passed to the petitioner on account of the initial truncated time. Even otherwise, the said time has been extended from 09.03.2026 to 30.03.2026 now by three other notifications. 7. Thereby crossing the minimum required time period of 15 days.
