Keeping in view the averments made in the application, duly supported by the affidavit of the official, delay of 96 days in filing the appeal is condoned. The application stands
disposed of.

Inter alia contends that the writ petitioners had challenged the order dated 19.10.2023 (Annexure P-6), wherein it had been noticed that there were 14 piecemeal workers ( Non ITI holder) senior to the representationist and therefore conversion
order could not be issued at present due to non-availability of vacant post of Workshop Helper of direct recruitment quota post. It was further observed that as and when a vacancy arises, he would be considered. It is submitted that the writ petition has been allowed only on the analogy of Annexure P-10, without dealing with the contention raised therein, which is also the specific contention taken in the reply. It is, thus, submitted that an employee cannot be allowed to jump the queue, particularly, when this aspect has already been considered.
Issue notice to the respondent, returnable within four weeks, on taking steps within one week.
Resultantly, till further orders, the operation of impugned judgment shall remain stayed.
