The petitioners are apprehending their arrest in connection with Lalpur P.S. Case No.260 of 2023, for the alleged offences registered under Sections 420, 406 & 34 of Indian Penal Code pending in the Court of learned JMFC at Ranchi. 3. Learned counsel appearing for the petitioners submits that an agreement to sell a flat was made between the informant and the petitioner nos. 1 and 2. He also submits that allegations are that the flat has not been handed over to the informant and further, it has been alleged that Rs. 6,60,500/- has been paid by the informant to the petitioners. He further submits that the said agreement was made on total consideration amount of Rs. 11,88,900/- and out of that 2026:JHHC:8175 --2-- A.B.A. No. 1322 of 2026 informant has only paid Rs. 6,60,500/-. He also submits that the project of the petitioner is now pending before the Hon’ble National Company Law Tribunal, New Delhi under the provisions of the Insolvency and Bankruptcy Code. 4. Learned counsel appearing for the State opposed the prayer and submits that the in spite of taking money of Rs. 6,60,500/-. 5. It appears that flat has not been handed over to informant and in the agreement, it has been stated that total consideration amount is of Rs. 11,88,900/- and it has been disclosed that Rs. 6,60,500/- paid by the informant. It is not clear that the entire consideration amount has been paid or not. The said project is also now pending before the Hon’ble National Company Law Tribunal, New Delhi under the provisions of the Insolvency and Bankruptcy Code. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within two weeks from today, and in the event of his surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned JMFC at Ranchi in connection with Lalpur P.S.
