Order 15/01/2026 The present misc. petition under Section 528 of BNSS has been filed on behalf of the petitioner against the order dated 16.09.2025 passed by learned Special Judge, SC/ST (Prevention of Atrocities) Cases, Sawai Madhopur in Session Case No.61/2018, whereby the learned trial Court partly allowed the application filed under Section 319 Cr.P.C. filed by the respondent No.2- complainant and ordered to commence criminal proceedings against the petitioner by arraying him as an accused in the matter and also summoned him through arrest warrant.
Learned counsel for the petitioner submits that he does not want to challenge the impugned order to the extent of commencing criminal proceedings against the petitioner while arraying him as an accused in the matter, but he submits that on
[2026:RJ-JP:1819] (2 of 2) [CRLMP-7468/2025] the first count, the learned trial court has issued arrest warrant against the petitioner, therefore he makes a limited prayer that the arrest warrant so issued against the petitioner may be converted into bailable warrant. Learned Public Prosecutor opposed the prayer made by the counsel for the petitioner. I have considered the arguments advanced before me and gone through the material available on record. Looking to the overall facts and circumstances of the case and in view of limited prayer made by the counsel for the petitioner, in the interest of justice, this Court deems it fit to convert the arrest warrant so issued against the petitioner by the trial court vide its order dated 16.09.2025 into bailable warrant. The petitioner is directed to appear before the learned trial Court on or before 06.02.2026 and submit his bail bonds to the satisfaction of the learned trial Court. The trial Court is directed to accept the bail bonds furnished by the petitioner. It is made clear that if the petitioner fails to appear before the learned trial Court on or before 06.02.2026, this order will lose its efficacy. The Criminal Misc. Petition is disposed of accordingly. Stay petition and pending application(s), if any, also
disposed of.
