The Court made the following:
ORDER:
The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity, ‘the Cr.P.C’) / Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), seeking to quash the condition of depositing 10% of the compensation amount imposed in the order dated 31.07.2025 passed in Crl.M.P.No.1114 of 2025 in Crl.A.No.111 of 2025 on the file of the learned Principal District and Sessions Judge, Nellore District. 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 3. There are altogether nine cases filed against the petitioner/appellant/Accused. In one case, the petitioner was convicted. The learned Single Judge of this Court stayed the sentence and directed the petitioner to pay 30% of the cheque amount, apart from 20% already paid by the petitioner at the appropriate time before the Court concerned. 4. The learned counsel for the petitioner submits that the financial condition of the petitioner is crippled and, if some time is granted to pay a certain amount, he would abide by those conditions. It is further submitted that the petitioner is not even in a position to pay 10% of the compensation amount as ordered by the learned Trial Court. 3 Dr. YLR, J Crl.P.No.2422 of 2026 Dated 30.03.2026
5. Considering the entire facts and circumstances of the case, the Criminal Petition is disposed of, directing the petitioner to deposit 7% of the compensation amount before the learned Trial Court within a period of six weeks from this date.
Subject to the above condition, the judgment dated 09.07.2025 passed in C.C.No.725 of 2019 by the learned II Additional Judicial Magistrate of First Class, Nellore, shall remain stayed. On deposit of 7% of the compensation amount, the complainant is at liberty to withdraw it by producing sufficient surety to the satisfaction of the learned Trial Court. 6. In the result, the Criminal Petition is disposed of. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y. LAKSHMANA RAO, J Date: 30.03.2026 RSI
