Ms. Sweta Badola Dobhal, learned Brief Holder for the State raised serious objection on the instant anticipatory bail application by submitting that the applicant already availed a remedy challenging the charge sheet by filing a petition under Section 528 of BNSS 2023 and bailable warrant was issued earlier by the Trial Court on 21.07.2023 and since then he is not cooperating with the trial. 4. In such view of the matter when the applicant already availed a remedy by filing the petition under Section 528 of BNSS 2023 being C528 No. 1018 of 2024 and bailable warrant was issued earlier, this Court is of the view that the applicant does not deserve for anticipatory bail and he may pursue the remedy which he has already availed. 5.
