No.1396 of 2026 ORDER This Writ Petition is filed to issue a Writ of Mandamus directing Respondents 1 - 2 to take appropriate action against 3-4 Respondents for committing criminal branch of trust, cheating and criminal intimidation based on the Petitioner's complaint dated on 27.01.2026 and on 06.02.2026. 2. The learned counsel for the petitioner submitted that the 3rd respondent is the brother of the petitioner and the 4th respondent is the mother of the petitioner. Earlier she was married to one Parthiban in the year 2009, during which time the 3rd and 4th respondent had given her 55 sovereigns of gold jewels and home appliances as sridhana. However, indifference crept in her matrimonial life and the petitioner had separated from her husband and she returned to her maternal home. During which time, the petitioner's husband had handed over all her 55 sovereigns gold and home appliances back to her father and mother. In the meanwhile, the petitioner had rejoined with her husband and her father had passed away in the year 2021. No.1396 of 2026 execute a release date with respect to certain ancestral properties and the petitioner volunteered to execute the same in Document No.2263 of 2022 on 11/3/2022 before the Thirumangalam Sub Registrar office on 11/3/2022. However, despite the petitioner's request, the 3rd and 4th respondents failed to return the 55 sovereigns gold jewelry. In this regard, the petitioner had indifferences with the 3rd and 4th respondent, following which at her instance, the 3rd respondent returned 30 sovereign jewelry and 25 sovereigns of jewels are yet to be received. In this regard, the petitioner had given a representation on 27/1/2026 to the first respondent, and the first respondent had forwarded the same to the second respondent. However, no action has been taken. Hence this petition. 3. The learned Government Advocate, submitted that already an enquiry in this regard has been conducted and considering the fact that the dispute involved is civil in nature, the parties were directed to resolve their disputes by approaching the proper civil forum. He also submitted that the petitioner did not furnish any material to substantiate her claim that 25 sovereigns of jewels belonging to her is still with her mother and 3/6 https://www.mhc.tn.gov.in/judis WP CRL.(MD). No.1396 of 2026 brother. 4. Heard either sides and carefully perused the materials available on record. 5. This Court is of the considered opinion that sridhana jewelry are the absolute property of women and the second respondent police should have dealt with the case with a little more sensibility. In view of the same without expressing any opinion and without going into the merits of the case, the second respondent is directed to reopen the case and conduct sensible enquiry and facilitate the petitioner, receive her sridhana jewellery back from her mother and brother. 6.
