IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No. 636 of 2026 Gangadhar Maharana …. Petitioner Mr. Rabi Narayan Mohanty, Advocate -versus- 1. The State of Odisha, represented by Principal Secretary, Home Department, Bhubaneswar 2. The Director General and Inspector General of Police, Cuttack 3. The DCP, Bhubaneswar 4. Inspector-In-Charge, Balianta Police Station …. Opp. Parties Mr. Saroj Kumar Rout, Additional Standing Counsel CORAM: HON’BLE MISS JUSTICE SAVITRI RATHO ORDER Order No. 19.05.2026 (Through hybrid Mode) 01. 1. This CRLMP has been filed with the following prayer:- “In light of the above stated facts and circumstances, it is, therefore, prayed that this Hon'ble Court may be graciously pleased to: a. Admit this case, issue notice and call for the records, b. Direct the IIC, Balianta Police station (Opp. Party No.4) to register the written complaint of the petitioner as First Information Report and investigate into the said matter so also complete the same as per law there under; c. Direct the concern authorities to take appropriate legal action to bring the Opp. Party No.3 & 4 into court of justice under relevant provisions of BNS made there under; AND d. Pass any other writ/writs and order(s)/direction(s) that Your Lordships may deem fit and proper in the interest of justice, equity and good conscience. And for this act of kindness, the petitioner shall as in duty bound, ever pray.” 2. The prayer to bring the Opposite Parties No. 3 and 4 into the Court of justice is totally misconceived, as Opposite Party No. 3 is the DCP, Bhubaneswar and Opposite Party No. 4 is the Inspector-In-Charge, Balianta Police Station. 3. Mr. Rabi Narayan Mohanty, learned counsel for the Petitioner submits that the second prayer is a result of “copy and paste”. 4. The allegation of the Petitioner is that his father has executed a sale deed and gift deed in favour of his daughter (sister of the Petitioner). He submits that it is a case of organized crime as his sister is not allowing the Petitioner to meet his father. He further submits that it is organized crime because they are four brothers and sister excluding Satyabhama Sahoo his sister and the family of his sister are threatening to assault the Petitioner whenever he wants to go and meet his father and if other people also go to her house, they are also threatened with assault them and eight months ago, his father was staying with the Petitioner, but thereafter the accused persons have prepared the documents and thereafter not allowing the Petitioner to meet his father. Although complaint in this regard has been submitted to the I.I.C., Balianta Police Station by speed post on 09.03.2026 and to the DCP, Bhubaneswar on 16.03.2026, no case has been registered. 5. In view of the nature of allegations, as I am satisfied that it is not a case of organized crime and as the accused in question is the sister of the Petitioner, I am not inclined to entertain this CRLMP, which is accordingly dismissed. 6. Urgent certified copy of this order be granted on proper application. (Savitri Ratho) Judge Sukanta Designation: Senior Stenographer
