Applicant Versus State of Maharashtra .. Respondent .................... Mr. Mithilesh Mishra a/w Mr. S.C. Mishra a/w Namasvi B., for the Applicant. Mrs. Sangeeta Phad, APP for the Respondent - State. Mr. Bhushan Raut, Nhava-Sheva Police Station present. ................... CORAM : MILIND N. JADHAV, J. DATE : OCTOBER 14, 2026 P.C.
:
1. Heard Mr. Mithilesh Mishra, learned Advocate for Applicant and Mrs. Sangeeta Phad, learned APP for Respondent. 2. This is an Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking bail in connection with C.R. No.171 of 2022 registered with Nhava-Sheva Police Station for offences punishable under Sections 364, 387, 120(B), 323, 504, 506 r/w 34 of the Indian Penal Code, 1860, under Sections 3 and 25 of the Arms Act, 1959 and under Sections 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organised Crime Act, 1999 (for short ‘MCOC Act’)
3. The Applicant in the present case is, in fact, implicated in a 1 of 4
22 - BA - 3916 - 2026 crime where MCOCA proceedings have also been invoked against him. The case of the prosecution is that he is a member of the gang and therefore, he is involved in the conspiracy with regard to the present crime. However, the precise or specific role of the Applicant is not spelt out. 4. Prima facie, the material which is placed on record shows that the Applicant was a driver, he has no antecedents, and his role is specifically limited, as emanating from the prosecution material. Considering the medical ailment that he is facing, whereby he has been specifically asked to undertake heart tests, a 2D Echo test and an ECG, and has also been prescribed medicines, which is prima facie seen from the medical report of the Applicant himself, issued by the JJ Group of Hospitals in the month of May 2026 itself, I am inclined to consider the request made by the Applicant on the ground that he has, till date, not been taken for any test since the JJ Hospital does not have the facility for the same, and release the Applicant on bail. 5.
5. In that view of the matter, the limited role attributed to the Applicant and more importantly, the fact that four years have elapsed and the trial has neither commenced nor concluded, persuade me to consider the case of the Applicant for grant of regular bail. 6. Hence, in view of above prima facie observations and findings, Bail Application of Applicant is allowed subject to the 2 of 4
22 - BA - 3916 - 2026 following terms and conditions:- (i) Applicant is directed to be immediately released from prison in connection with CR.No.171 of 2022; (ii) Applicant is directed to be released on bail on furnishing P.R. Bond of Rs.25,000/- (Rs. Applicant shall not seek unnecessary adjournments. Any such conduct shall entitle the prosecution to apply for cancellation of bail; (v) Applicant shall not leave the State of Maharashtra without prior permission of the Trial Court; (vi) Applicant shall not influence any of the witnesses or tamper with the evidence in any manner; 3 of 4
22 - BA - 3916 - 2026 (vii) Applicant shall keep the Investigating Officer informed of his current residential address and mobile telephone number and shall forthwith inform the Investigating Officer of any change in his residential address or mobile telephone number, as and when such change occurs; and (viii)Any breach or infraction of any of the aforesaid conditions shall entail cancellation of the bail granted to the Applicant. 7. It is clarified that the observations made in this order are limited for the purpose of granting bail only and I have not made any observations on merits of the case. The trial shall be adjudicated on the strength of the evidence led and strictly on its own merits being uninfluenced with any of the prima facie observations made hereinabove in this order. 8. Bail Application is allowed and disposed in the above terms. [ MILIND N. JADHAV, J. ] 4 of 4
