JUSTICE S VISHWAJITH SHETTY ORAL ORDER The accused No.2 in S.C.No.5092/2025 pending before the Court of III Additional District and Sessions Judge, Bengaluru, Sitting at Anekal, arising out of Crime No.114/2025 registered by Bannerghatta Police Station, Bangalore, for the offences punishable under Sections 189(2), 191(3), 351(2), 351(3), 352, 103(1), 190 of Bharatiya Nyaya Sanhitha, 2023 (hereinafter referred to as 'BNS, 2023' for short, is before this Court in this criminal petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent/State. - 3 - HC-KAR NC: 2026:KHC:27060 CRL.P No. 1321 of 2026 3. FIR Crime No. 114/2025 was registered by the Bannerghatta Police Station, Bangalore initially for offences punishable under Sections 103(1), 351(2), 352 r/w 3(5) of BNS, 2023 against one Kantharaj and others, based on the first information dated 26.04.2025 received from Smt. Monika wife of Sri. Suresh. During the course of investigation petitioner herein was arrested on 26.04.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against 4 persons. Petitioner is arraigned as accused no. 2 in the charge sheet. His bail application filed before the trial Court in Crl.Misc.No.5612/2025 was rejected on 12.01.2026. Therefore, he is before this Court. 4. Undisputedly petitioner's name is not found in the FIR. During the course of investigation petitioner was arrested and remanded to judicial custody. In the charge sheet which is filed subsequently it is alleged that on 25.04.2025 when accused no. 1 was consuming alcohol in a bar and restaurant, he had quarrelled with the deceased. - 4 - HC-KAR NC: 2026:KHC:27060 CRL.P No. 1321 of 2026 C.W.2 and C.W.3 had pacifed them and thereafter, deceased had gone to his house. At about 10.45 p.m. on the said date, accused nos. 1 to 4 along with another juvenile accused went near the house of deceased Suresh Kumar and after quarrelling with him allegedly had assaulted him. The allegation of assaulting deceased Suresh Kumar with a knife on the vital part of his body is found in the charge sheet only as against accused no. 1. The other accused, who were present along with accused no. 1, allegedly had caught hold of deceased and also had assaulted him with their hands. Accused no. 4, as against whom similar allegation is made in the charge sheet, has been granted regular bail by the Co-ordinate Bench of this Court in Crl.P.No. 17354/2025 disposed of on 19.01.2026. It is not in dispute that the petitioner has no other criminal antecedents. 5. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively on the ground of - 5 - HC-KAR NC: 2026:KHC:27060 CRL.P No. 1321 of 2026 parity, subject to appropriate conditions. Accordingly, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.5092/2025 pending before the Court of III Additional District and Sessions Judge, Bengaluru, Sitting at Anekal, arising out of Crime No.114/2025 registered by Bannerghatta Police Station, Bangalore, for the offences punishable under Sections 189(2), 191(3), 351(2), 351(3), 352, 103(1), 190 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the date of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 6 - HC-KAR NC: 2026:KHC:27060 CRL.P No. 1321 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
