This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant, who is apprehending his arrest in connection with Crime No.50/2026 registered at Police Station – SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.05.11 10:34:33 +0530
2 Marwahi, District - GPM, (C.G.) for the offence punishable under Sections 318(4) and 3(5) of BNS.

Briefly stated, case of the prosecution is that the complainant Vishnu Prasad Rathore lodged a written complaint at Police Station Marwahi on 23.03.2026 alleging that the present Applicant and other accused persons induced him to purchase alleged gold coins claimed to have been found during farming activities. After initially receiving a small amount through PhonePe, the complainant, along with others, met the Applicant and other accused persons near a forest area where approximately 440 grams of purported gold was shown and tested. Believing the same to be genuine, the complainant paid Rs.2,00,000/- in cash to them. Subsequently, upon verification by a jeweller, the gold was found to be fake. It is alleged that the Applicant and other accused persons cheated the complainant by dishonestly inducing him to part with the said amount. Based on the aforesaid allegations, the offences as mentioned above have been registered against the present Applicant. Hence, this application.

Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that no amount has been transferred by
3 the complainant to the account of the present Applicant, no test identification parade has been conducted, the offence is triable by the Magistrate and trial is likely to take considerable time for its conclusion, therefore, he may be extended the benefit of anticipatory bail.

Learned counsel for the State, opposed the prayer for anticipatory bail and submitted that the present Applicant is having six previous criminal antecedents and therefore, his application for anticipatory bail may be rejected.

Having heard learned Counsel for the parties and having considered the facts and circumstances of the case, particularly considering the limited role attributed to the present Applicant, the fact that no amount has been transferred to his account, no test identification parade has been conducted and that the offence is triable by the Magistrate and the trial may take considerable time for its conclusion, this Court is inclined to allow the anticipatory bail application.
6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Rohit Parasate, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:-
4 (a) The applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her/him/them from disclosing such fact to the Court. (b) The applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant/s shall appear before the trial Court on each and every date given to her/him/them by the said Court till disposal of the trial. (d) The applicant/s and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant/s shall not involve herself/himself/themselves in any offence of similar nature in future. Sd/-
