1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 303(2), 318(2), 318(4), 338, 319(2), 336(3), 340(2), 317(5), 111 and 61(2) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he received an information from E.O.U., Patna that Kundan Kumar through Account No.110271865997 is committing cyber fraud. Accordingly, house of Kundan was raided, who disclosed that aforesaid account belongs to him. Further, on verification through cyber crime portal, it transpired that multiple complaints from different States including

Further, mobile of Kundan was seized and Kundan disclosed that he along with petitioner are involved in committing cyber fraud and proceeds of a crime is shared in between them. Further, EMI payment of petitioner’s motorcycle was also paid from the said account. 4. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case being co-villager of Kundan. It is next submitted that thrust of the allegation of committing cyber fraud is against Kundan, but then, fairly admits that EMI payment of petitioner’s motorcycle was paid from the said account of Kundan, but then the said EMI was paid for the reason that petitioner had given Kundan some money on loan in cash which he was trying to return by paying his EMI. 5. Learned A.P.P. vehemently opposes the anticipatory bail application and submits that it is a case of cyber fraud and the petitioner does not dispute that he does not know Kundan and from account of Kundan, EMI amount was also paid for motorcycle of the petitioner.
It is also submitted that investigation of the case is in its nascent stages and if privilege of anticipatory bail is granted, the petitioner may abscond. Patna High Court CR. MISC. No.39766 of 2026(2) dt.24-06-2026 3/3
6. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner. 7. The prayer of the petitioner for anticipatory bail stands rejected. vikash/- (Satyavrat Verma, J) U T
