1. Learned counsel for the respondent-State submit that this petition prima facie appears to be premature. He contended that according to the documents enclosed along with writ petition Annexure P/1 it is appearing that the respondent authorities after publication of the list of suitable candidates based on seniority have called objection from aggrieved employees on 30.04.2026. The petitioner could have submitted representation/objection instead of filing this writ petition and it could have been considered by the concerned authorities. 2. Counsel for the petitioner submits that petition has already submitted objection on 28.04.2026 and this writ petition is filed on the apprehension that the representation/objection would not be considered in favour of the petitioner in appropriate manner. 3. I have heard learned counsel for the parties. 4. Perusal of the document Annexure P/1 would show that along with covering memo dated 23.04.2026 the respondent authorities have also published list of eligible head constable who are under zone of consideration for their promotion mentioning that this list is according to the seniority of the head constable as maintained in the concerned department. Grievance of the petitioner is that petitioner had been shown below head constable who had joined the post of head
3 constable after the petitioner and date of promotion is also after the date of appointment of the petitioner.
When respondent authorities have already issued notice to all head constables who are under consideration for their promotion, to submit an objection if any on the list published by the department and pursuant thereto petitioner has already submitted objection, therefore, this Court is not passing any order on merits however, it is expected from the respondent authorities to consider and take decision on all the objections received pursuant to notice dated 23.04.2026 in accordance with law, before issuing order of promotion. 5. With the aforesaid observation and direction, this writ petition stands finally disposed of. Sd/-
