JUSTICE SATYAVRAT VERMA ORAL ORDER 2 25-06-2026 1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita. 3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner nos. Patna High Court CR. MISC. No.39782 of 2026(2) dt.25-06-2026 2/3 2 and 7 are women and the informant alleges that on 15-1-2026 at 6:30 pm, she along with her minor daughter had gone to attend nature’s call when eight named accused persons including the petitioners came on a white Scorpio and Bablu pointed pistol at her daughter and accused persons made her sit in the vehicle and kidnapped her with an intent to marry and assaulted the informant by fist and slap when she tried to save her daughter. 4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that petitioner nos. 2 and 5 are parents of Bablu and rest of the petitioners are co-villagers. It is further submitted that Bablu is not a petitioner in the instant anticipatory bail application. It is also submitted that the victim was recovered and her statement was recorded under Section 183 BNSS, wherein she supported the case of the prosecution but then it is submitted that the statement of the victim was recorded under parental pressure in order to implicate the family members of Bablu including co-villagers. It is next submitted that informant realising her mistake on intervention of well- wishers has filed a compromise petition before the learned trial court, as would manifest from Annexure-2 to the anticipatory bail application. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Tariyani P.S.
