The revisional application has been preferred by the wife/petitioner praying for transfer of Act VIII Case No. 89 of 2024 under Sections 7, 17 and 25 of the Guardians and Wards Act, 1980, pending in the Court of the learned Additional District Judge, Fast Track 4th Court at Barasat, District-North 24 Parganas to the Court of the Learned District Judge at Alipore, District- South 24 Parganas. 2. It is the case of the petitioner/wife that she is currently residing with her child (ordinary place of residence) at 3/60, Rabindra Nagar, Parnasree Pally, P.O. & P.S. Parnasree, Kolkata- 700 060, District- South 24 Parganas. 3. On the other hand the husband/opposite party is a resident of Ghola, Md. Kalachand Road, P.O. & P.S. Ghola, District- North 24 Parganas, PIN- 700 111 and has filed the case in Barasat Court. 4. The petitioner/wife now prays that the case being Act VIII Case being No. 89 of 2024 pending in the Court of the learned Additional District Judge, Fast Track 4th Court at Barasat, District-North 24 Parganas be transferred to the Court of the Learned 2 District Judge at Alipore, District- South 24 Parganas. 5. Accordingly, in view of this Court’s order dated 27.03.2026 in CO 4128 of 2024, Shantilal Sharma Vs. Susant Vyas @ Sushanta Vyas & Ors., the revisional application is required to be heard in presence of the opposite party. 6. Petitioner is directed to serve upon the opposite party and file affidavit of service on the next date of hearing. 7. Pending hearing of the revisional application under Section 24 of the Civil Procedure Code, the proceedings in Act VIII Case No. 89 of 2024 pending in the Court of the learned Additional District Judge, Fast Track 4th Court at Barasat, District-North 24 Parganas be stayed till 17th July, 2026 or until further order, whichever is earlier. 8.
