Learned AGA accepts notice for the respondents. 2. The petitioner is before this Court, seeking the following reliefs: “a) Issue a writ in the nature of mandamus directing the Respondent No.2 to comply with the directions dated 04.01.2026 issued by the Respondent No.1 at Annexure-G. b) Pass such other writ, order or direction that this Hon'ble Court deems fit to pass in the circumstances of the case.” 3. The petitioner alleges that in respect to the property of the petitioner, a gift deed had been executed on 19.09.2025 by a person impersonating the - 3 - HC-KAR NC: 2026:KHC:26640 WP No. 14522 of 2026 petitioner, in furtherance of which, a complaint had been filed by the petitioner with the first respondent. The first respondent, considering the same, had conducted a preliminary inquiry and by way of its endorsement dated 04.01.2026 had directed respondent No.2 to file a police complaint before respondent No.3 in terms of Sections 82 and 83 of the Indian Registration Act, as amended. Despite the said order having been passed on 04.01.2026, the grievance of the petitioner is that no steps have been taken by respondent No. 2 to file such a complaint. 4. Once a superior officer directs a subordinate to take any particular action, it is but required for the subordinate to take such action within a reasonable time. The superior's orders in the present matter having been passed on 04.01.2026, no action has been taken by respondent No.2 for more than 5 months from that date. The same, in this Court's - 4 - HC-KAR NC: 2026:KHC:26640 WP No. 14522 of 2026 considered opinion would also amount to insubordination on the part of respondent No. 2. 5. In that view of the matter, this Court passes the following: ORDER (i) Writ petition is allowed. (ii) A mandamus is issued directing respondent No. 2 to act on the directions issued by respondent No. 1 within a period of two weeks from the date of receipt of a copy of this order. (iii) The Principal Secretary of Revenue Department is directed to look into the matter and take such appropriate action against respondent No.2 for insubordination as indicated supra and file a report within a period of six weeks from the date of receipt of a copy of this order. - 5 - HC-KAR NC: 2026:KHC:26640 WP No. 14522 of 2026 (iv) Re-list for receipt of the report on 15.07.2026.
