The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records with regard to the auction proceeding initiated by the respondent no. 3 with regard to the land bearing Nazul Sheet No. 41, plot / khasra no. 8 area about 1550 sqft., ward Indira Nagar Tahsil and District - Raigarh (C.G.) 10.2 That, this Hon'ble Court may kindly be pleased to set-aside the impugned auction proceeding (Annexure P-1) initiated by the respondent no. 3. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent no. 3 in light of notification dated 11.09.2019 (Annexure P-2) consider and decide finally, the petitioner's revenue case which is pending before him after given due opportunity of hearing. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit. 10.5 Cost of the petition may also be awarded.” 2. Learned counsel for the petitioner submits that petitioner is in possession of the nazul land bearing Nazul Sheet/Plot No. 41 of Khasra No. 8 admeasuring 1550 sq. feet at Indira Nagar Ward, Tehsil & District – Raigarh since long time. The State Government had issued circular/guidelines on 11.09.2019 for allotment/settlement/Grant of Bhumi Swami right. After making payment of the amount as per the calculation to be made in accordance with the circular. After getting knowledge of the said circular, petitioner submitted an application 3 before the Respondent No. 3 for settlement of the land in favour of the petitioner on 17.02.2020 mentioning that the petitioner is ready to pay the requisite amount as and when directed. Upon receipt of application of the petitioner, Respondent No. 3 issued memo of proclamation calling objection on the settlement of the land subject matter of application and further issued notice in the newspaper dated 22.06.2020. However, no objection was received on the application submitted by the petitioner for allotment of the land. The Respondent authority in contravention of the circular/guidelines dated 11.09.2019 had started the proceedings of auction of the land which is subject matter of application submitted by the petitioner for settlement without giving any notice or opportunity of hearing to the petitioner. Petitioner thereafter, submitted an application before the Respondent No. 3 with a prayer to suspend the auction proceedings which was not considered and decided. Accordingly, the writ petition is filed. 3. He contended that the auction proceedings can be initiated when there is more than one claim on the land as per the circular dated 11.09.2019 (Annexure P/2). He submits that in the facts of the case, the auction proceedings initiated by the Respondent No. 3 be set-aside and direction be issued to the Respondent No. 3 in light of the notification dated 11.09.2019 to consider and decide the application submitted by the petitioner for settlement of the land subject matter of writ petition. 4. On the other hand, learned counsel for the Respondents/State submits that reply has not been filed to the writ petition, however, he submits that the circular based on which, petitioner is claiming right and has filed writ petition, seeking the relief as mentioned therein, has been withdrawn by issuing other subsequent circular dated 23.07.2024 and 4 therefore, petitioner would not be entitle for the reliefs as sought for in the writ petition. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. From perusal of the pleadings made in the writ petition and the relief clause, it is apparent that the petitioner is claiming the relief based on the circular issued by the State Government dated 11.09.2019 which provides for the allotment/settlement of the government land possessed by the person. The State Government vide circular dated 23.07.2024 has been canceled the circular dated 11.09.2019. 7. In the aforementioned facts of the case, where the circular based upon which, the petitioner is claiming his right to get relief is not in existence as it has been canceled, no relief as prayed for can be granted now.
