Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 15/05/2026
1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 This Hon'ble Court may kindly be pleased to set aside the impugned show cause notice dated 20.04.2026 (Annexure P-1) and proceedings pending before respondent No.03 in revenue case 202604321100021 year 2025-2026 (Annexure P-2). 10.2 Any appropriate writ, direction or order may also kindly be passed in favour of the petitioners, which this Hon'ble Court deems fit in the circumstances of the case.”
2. Learned counsel for the petitioner submits that the present petition has been filed challenging the impugned notice whereby proceedings have been directed to be initiated against the petitioner under Section 40 of the Chhattisgarh Panchayat Raj Act, 1993. It is submitted that the action initiated against the petitioner is arbitrary and contrary to the provisions of law. 3
3. On the other hand, learned counsel appearing for the State submits that the petitioner has already submitted his reply before the competent authority and thereafter further proceedings have also been initiated in accordance with law. It is further submitted that the grievance raised by the petitioner can adequately be considered and redressed by the competent authority itself during the course of the proceedings. 4. I have heard learned counsel for the parties at length and have also perused the material available on record. 5.
Considering the facts and circumstances of the case, and further taking into account that the proceedings are already pending before the competent authority, this Court deems it appropriate to direct the petitioner to extend full cooperation in the said proceedings. The concerned SDO (Revenue) is also directed to duly consider the reply and objections submitted by the petitioner and to decide the matter strictly in accordance with law, after affording due opportunity of hearing to the petitioner, preferably within a period of five months from the date of receipt of a copy of this order. 6. With this observation and direction, the writ petition is disposed of. Sd/- (Amitendra Kishore Prasad) Judge Raghu Jat
