This application stands disposed of. BAIL APPLN. 4049/2026 1. This is second application under Section 483 Bharatiya Nagarik Suraksha Sanhita, 2023, (BNSS) seeking extension of interim bail for a period of two months in case FIR No. 385/2025 registered under Sections 310(2)/3(5)/204/317(2)/61(2)(a) of Bharatiya Nyaya Sanhita, 2023 (BNS) at Police Station R K Puram. 2. The petitioner was initially granted interim bail for a period of 30 days on medical grounds vide the order dated 10th August, 2026 passed by the learned ASJ-02, Patiala House Courts, New Delhi which was subsequently extended by another 15 days vide order dated 10th September, 2026, passed by the learned ASJ-02, Patiala House Courts, New Delhi. The learned counsel for the petitioner submits that the petitioner suffers from serious cardiac ailments including coronary artery disease (CAD), Acute Coronary Syndrome (ACS) and severe Left Ventricular Dysfunction with a history of angioplasty/stent implantation, besides other ailments. 4. He further submits that during his treatment at AIIMS further blockages were detected and the proposed procedure was postponed for expert opinion and on 21st September, 2026, the cardiologist recommended Coronary Artery Bypass Grafting (CABG) at the earliest. 5. On account of this reason, further extension of two months has been sought. However, he admits that he did not file any application for further extension of bail before the learned Trial Court. 6. After part submissions, the learned counsel for the petitioner does not press the present application and seeks permission to withdraw the same with liberty to file application for extension of interim bail before the learned Trial Court. 7. The statement made by the learned counsel is taken on record. 8. The application is dismissed as withdrawn with liberty as prayed for. It is clarified that as and when such application is filed, the same be decided on its own merits. 9. Copy of this order be given dasti under the signatures of Court Master.
