JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: "PRAYER WHEREFORE the petitioners most humbly prays that this Hon'ble Court may be pleased to: a. Issue a writ in the nature of Mandamus or any other appropriate writ, order or direction directing the Respondents to consider the representation dated 21.05.2026 at Annexure "A" submitted by the Petitioners requesting the Respondents not to illegally - 3 - HC-KAR NC: 2026:KHC:25302 WP No. 15960 of 2026 widen the existing road by encroaching upon the Petitioners' properties without following the due process of law. b. Pass such other order or orders as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity." 2. Learned counsel appearing for the petitioners submits that the petitioners had given a representation dated 21.05.2026 to the respondents not to illegally widen the existing road by encroaching upon the petitioner's properties without following the due process of law. It is submitted that the respondents without following the due process of law are interfering with the petitioners' peaceful possession and enjoyment of the property. 3. It is submitted that the petitioners have already served the writ petition papers on learned counsel Sri.M.S.Devaraj, for respondent No.4. 4. There is no representation on behalf of the counsel for respondent. 5. Having heard the learned counsel for the petitioner, perused the entire material on record. The limited prayer that is sought before this Court is to direct the respondents to consider - 4 - HC-KAR NC: 2026:KHC:25302 WP No. 15960 of 2026 the representation dated 21.05.2026 and by virtue of the representation, the petitioners are seeking a direction to the respondents not to lay the road by encroaching the petitioners' properties. In that view of the matter, this Court is passing the following order: ORDER i. The respondent No.4 is directed to consider the representation dated 21.05.2026 in accordance with law within a period of four weeks from the date of receipt of copy of this order. ii. The respondents are directed not to dispossess the petitioners without following the due process of law. iii. Accordingly, the writ petition is disposed of. iv.
