Mr. Sourav Mitra, who usually appears for the State is present in Court and is requested to appear in this matter. Let his appointment in this matter be regularized. 4. The petitioner is aggrieved that in spite of the refund, made by the concerned department pursuant to the order of this Hon’ble Court dated March 07, 2024, his basic pay and monthly pension have not yet been refixed. 5. I direct the respondent no. 4 to refix the basic pay and the monthly pension payable to the writ petitioner on the basis of his last drawn pay and consequential orders are to be passed by the respondent no. 3. 6. I make it clear that the respondent no. 4 will complete the entire exercise by May 31, 2026 in light of 2 the decisions of this Hon’ble Court in The State of West Bengal & Ors. vs. Harekrishna Sardar & Anr. reported in 2009 (2) CLJ (Cal) 259 and Chittaranjan Maiti vs. State of West Bengal & Ors. reported in 2010 (2) CLJ (Cal) 241. Once the respondent no. 4 takes the appropriate decision, the respondent no. 3 will act in accordance the same and issue a fresh Pension Payment Order in favour of the petitioner. 7. With these directions, the writ petition is disposed of. No order as to costs. 8.
