GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, Direction or Order, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent No.4 in compelling the petitioners to come to the police station on every Sunday 3 pursuant to Crime No.75 of 2024 on the file of Unguturu Police Station, Krishna District, registered for the alleged offences under Sections 143, 323 and 427 r/w 149 of the I PC, dated 14.05.2024, and subjecting them to continuous harassment and unlawful restraint, as bad, illegal, arbitrary, discriminatory, contrary to law and violative of the principles of natural justice, and consequently direct the Respondent No.4 to call for the entire records pertaining to the petitioners, including the CCTV footage of Unguturu Police Station till date, for the purpose of examining the illegal detention and restraint of the. petitioners in the police station on every Sunday…” 2. Heard the learned counsel for Petitioners and learned Assistant Government Pleader. 3. Ms. V. Devi Satya Sri, learned counsel for the Petitioners, submits that Respondent No.4 is compelling the Petitioners to attend the Police Station every Sunday pursuant to Crime No. 75 of 2024 on the file of Unguturu Police Station, Krishna District, registered for the alleged offences under Sections 143, 323, and 427 read with 149 of the Indian Penal Code, 1860 (for brevity, ‘the I.P.C.,’) dated 14.05.2024, and subjecting them to continuous harassment and unlawful restraint. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the Petitioners, who are eight in number, have been shown in the suspect sheet opened against them in accordance with law. 5. Having regard to the facts and circumstances of the case, and in view of the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Petitioners shall attend before the Respondent Police. However, the Respondent Police are directed to strictly follow the directions of the Hon’ble Division Bench of this Court in its order 4 dated 12.09.2022 in I.A. No. 01 of 2022 in Writ Appeal No. 674 of 2022. Liberty is granted to the Petitioners to challenge the suspect sheet opened against them by the Respondent Police, if so advised. 6.
