For Respondents No. 3 and 4 : Mr. Navoday Singh, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board Digitally signed by AJINKYA PANSARE Date: 2026.05.15 10:34:53 +0530 2 14.5.2026 1) By way of this petition, petitioner has sought following reliefs:- 10.1 This Hon'ble Court may kindly be pleased to issue appropriate writ/order/direction and direct the respondent authorities to grant of benefit of higher pay scale/Time Bound Pay Scale to the petitioner. 10.2 This Hon'ble Court may kindly be pleased to issue appropriate writ/order/direction and direct the respondent authorities to grant the arrears of payment of Time Bound Pay Scale to the petitioner from the date of completion of 7 years of his service till the actual payment of Time Bound Pay Scale with interest @10% per annum. 10.3 This Hon'ble Court may kindly further be pleased to direct the respondent authorities to grant the benefit of promotion to the petitioner. 10.4 Any appropriate writ, direction or order may also kindly be passed in favour of the petitioner, which this Hon’ble Court deems fit in the circumstances of the case. 2) Learned counsel for the petitioner submits that initially petitioner was appointed to the post of Shiksha Karmi Grade-II vide order dated 2.1.2009 and he completed seven years of service on 7.1.2016. He further submits that services of petitioner were absorbed with the School Education Department vide order dated 1.8.2018 but till date benefit of time scale pay has not been extended. He contends that Block Education Officer, Bilaigarh vide memo dated 4.12.2021 assessed the amount of arrears of time scale pay but till date said amount has not been paid to the petitioner. He prays for a direction to the respondent authorities to make payment of arrears of time scale pay. 3 3) On the other hand, learned counsel for the respondents would oppose. They submit that grievance of petitioner with regard to revision of pay-scale has already been settled and this fact is evident from the rejoinder filed by the petitioner himself. They further submit that this petition has become infructuous. 4) Heard. 5) Perusal of rejoinder filed by the petitioner makes it clear that claim of petitioner with regard to revision of pay scale has already been settled. However, it appears that petitioner has not been paid arrears of time scale pay though it was calculated by the concerned Block Education Officer vide its memo dated 4.12.2021. 6) Taking into consideration the above-stated facts, this petition is hereby being disposed reserving liberty in favor of petitioner to make a representation within period of 30 days before respondents No. 3 and 5 claiming therein arrears of time scale pay pursuant to memo dated 4.12.2021. It is expected that the authorities concerned shall consider the representation made by the petitioner and make payment of arrears of time scale pay at the earliest, if already not paid. 7) With the aforesaid direction, this petition stands disposed.
