This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.27/2026 registered at Police Station Telibandha, District Raipur (C.G.) for the offence under Section 20(b)(ii)(B) of NDPS Act, 1985. As per the prosecution case, on 26.01.2026, the police authorities of Police Station Telibandha, District Raipur (C.G.), received secret information to the effect that a person was attempting to sell Ganja while carrying the same in a white plastic bag near Sheetala Talab, Avanti Vihar. Acting upon the said information, the police apprehended the present applicant/accused and, upon search, allegedly recovered 4.347 kilograms of Ganja from his possession. On the basis of the aforesaid recovery, an FIR came to be registered against the applicant and, after completion of investigation, charge-sheet has been filed for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Learned counsel for the applicant submits that the applicant is innocent and have been falsely implicated in the present case. It is contended that they have been in judicial custody since 26.01.2026 and the charge-sheet has been filed. It is further submitted that the investigation has not been conducted properly. The applicant is permanent residents with no likelihood of absconding and is ready to furnish adequate surety and abide by all conditions imposed by this Court. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the applicant has 07 previous antecedents and out of which one is of the NDPS Act of the year of 2025, therefore, the present applicant is not entitled for bail. 3 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, particularly the nature and gravity of the allegations levelled against the applicant, the quantity of contraband allegedly seized from his possession, and further taking into account that the applicant has as many as seven criminal antecedents, including one case registered under the provisions of the NDPS Act which is of the year of 2025, therefore, this Court is not inclined to extend the benefit of bail to the applicant at this stage. 7. Accordingly, the bail application of applicant – Vishal @ Ganga Yadav involved in Crime No. 27/2026, registered at Police Station- Telibandha, District – Raipur (C.G.) for the offence punishable under Section 20(b)(ii)(B) of the NDPS Act is rejected. 8.
