JUSTICE JASMEET SINGH O R D E R % 18.09.2026 1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- a. Direct the respondent No.1 and 2 to perform their duties and take measures for constructing “20” ft. vide Road adjacent to street No.3 of EVN i.e. at Khasara Number 76/2 (Pt. of Khasara No.76) and to develop a Park in this big vacant area as per the Sanction Development Plan by MCD TOWN PLANING DEPARTMENT on l 1-07-2011 b. Direct the respondent No.3 to ensure the protection of the life and property of the petitioner, c. restrain the respondent No.l and 2 from changing the use of This is a digitally signed order. In the present case, the petitioner is a resident of J Block Resident Welfare Society, and there is a large vacant tract of land in the society. It is stated that the vacant land is meant for developing a 20ft. road and a public path for the welfare of the residents of the society. 3. My attention has been brought to Annexure-P-1, which is the sanctioned plan, wherein the area in question has been shown as a park. The counter-affidavit filed by respondent No. 1/DDA also indicates that after acquisition, the land is with respondent No. 1/DDA. However, respondent No. 1/DDA states that the Engineering Department cannot construct the alleged 20 ft. road or develop a public park over the subject land. The said does not stand appears to be supported with any approval or direction from the competent authority. 4. Respondent No. 1/DDA, for the aforesaid reasons, has not taken any further steps. It is further stated that vide order dated 25.03.2025, in RSA No. 193/2014, respondent No.1/DDA has been permitted to secure the land in question. 5. A perusal of the sanctioned site plan clearly shows the area in question as park. The existence of any provision of a road over the said area is also not borne out from the layout plan annexed as Annexure P-1. 6. In view of the aforesaid, respondent No. 1/DDA shall take all necessary steps to develop the subject area as a park for the benefit of the residents of the colony. 7. The aforesaid exercise shall be undertaken expeditiously and in any event be completed within a period of 8 weeks from today. This is a digitally signed order.
