In this petition the petitioner Pakesh Kumar is praying for quashing of the First Information Report dated 16.12.2025 bearing FIR No. 0317 of 2025, P.S. ITI Kashipur, District Udham Singh Nagar, wherein, the petitioner has been implicated for the offence punishable under section 316(2), 351(2), 352 and 79 of BNS, 2023. 5. IA 2/2026 has been moved, which is in the form of compromise application, however the same is being treated as a compounding application. 6. Now, it is contended in the IA 2/2026 that the parties have settled their disputes and the complainant, who is present in court along with the petitioner, who are identified by their respective counsel, also submits that she does not want to pursue this FIR. 7. Learned counsel for the parties also submits that all the offences in which the FIR has been lodged are compoundable. 8. Mr. Sandhu, learned Additional Advocate General, also submits that all the offences are compoundable and if the complainant does not want to pursue with the impugned FIR then in such an eventuality there is no useful purpose to go with the investigation and, as such, the compounding application can be allowed. 9. In such view of the matter, when the parties have settled their disputes and complainant also does not want to pursue with the impugned FIR and all offences are compoundable, this court is of the view that the writ petition as well as the compounding deserves to be allowed. Accordingly, writ petition as well as compounding application are allowed. The impugned FIR dated 16.12.2025 bearing FIR No. 0317 of 2025 is also hereby quashed. (Rakesh Thapliyal, J.) 02.04.2026 PR
