1. By virtue of the present petition under Articles 226/227 of the Constitution of India, the petitioner seeks following reliefs:
“a) Issue a Writ of Mandamus or any other appropriate Writ, Order, or Direction in the nature thereof, directing the Respondent No. 1/BRPL to forthwith energize and provide a new non-domestic electricity connection at the Petitioner's property Basement Shop No. B-9A, South Ex Plaza-1, Masjid Moth, New Delhi, treating the Petitioner's ownership documents Sale Deed/Mutation as sufficient compliance under the DERC (Supply Code) Regulations, 2017, whereby the petitioner applied for a new non-domestic electricity connection before the Respondent no.1/BRPL vide application no. ONHKS1910221060 on dated 19.10.2022, This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. ANHKS1610240401 on 16.10.2024, 008008018065 dated 09.12.2025, and new application no. ONI-IKS1808262264 and ONHKS1808262288 dated 19.08.2026, without insisting upon a Fire Safety NOC or MCD clearances, which are currently unattainable and not a pre-condition for an individual connection under the prevailing DERC regulations;
b) Pass an ex-parte ad-interim
order directing Respondent No. 1 to provisionally install an electricity meter and connection at the subject premises as soon as possible of this order during the pendency of the present petition, to alleviate the severe hardship and irreparable loss suffered by the 70- years old senior citizen Petitioner due to the property remaining in total darkness and without essential utility services since 2022;”
2. A perusal of the record reveals that the present petition is the second round of litigation whereby the earlier writ petition being W.P.(C) 10517/2026, was filed by the very sane petitioner herein, which was
disposed of vide order dated 29.07.2026 whilst recording as under:-
“2. The present writ petition has been filed seeking a direction to the respondent/BRPL to provide a new non- domestic electricity connection at the petitioner’s property at Basement Shop No. B-9A, South Ex Plaza-1, Masjid Moth, New Delhi.
3. Mr. Sharique Hussain, counsel appearing on behalf of the respondent/BRPL on advance notice, submits that the petitioner had also filed a suit before the competent court at Saket District Courts for the same relief and the said suit is still pending. He further submits that since the petitioner is asking for a non-domestic electricity connection for a shop, a fire NOC would be required for the same.
4. Counsel appearing on behalf of the petitioner submits that the petitioner shall withdraw the civil suit filed by her. application before the Fire Department for grant of a Fire NOC.
5. In view of the aforesaid submissions, the present writ petition is disposed of while granting liberty to the petitioner to approach this Court, if the grievance of the petitioner still survives.”

Learned counsel for the petitioner submits that pursuant to the above, the petitioner has withdrawn the civil suit on 18.08.2026 before CJ- 01(South) Saket/New Delhi, copy of the said order has been filed herein.

He further submits that though the petitioner had applied for a Fire Safety Certificate, however, an order thereto has been passed by the Government of National Capital Territory of Delhi Headquarters: Delhi Fire Service New Delhi on 28.08.2026, whereby the petitioner has been requested to submit “… …the application along with building plans including section/elevation of the premises through local authority concerned for issuance of Fire safety certificate”.

There is no dispute about the factum that the petitioner has not produced the aforesaid building plans wherein the subject premises (basement) of the petitioner is situated in compliance of the earlier order passed by this Court on 29.07.2026 in W.P.(C) 10517/2026, and instead has directly approached this Court, without producing the same before the incumbent authority.
6. As such, there is hardly any reason for this Court to entertain the present petition.
7. At this stage, learned counsel for the petitioner seeks to withdraw the present petition with liberty to seek appropriate remedies in accordance with law, if as and when required. 8. Thus, the present petition, alongwith pending applications, is dismissed as withdrawn.
