By the present writ petition, the petitioner is seeking quashment of part of the impugned transfer order dated 24/04/2026 (Annexure P-1) passed by respondent No.3/ Controller, Legal Metrology Department, Raipur (C.G.). Learned counsel appearing for the petitioner submits that the petitioner is working as Inspector, Legal Metrology Department and was posted at Korba. He submits that the petitioner was placed under suspension vide order dated 05/12/2025 (Annexure P-2) passed by respondent No.3 and subsequently, the said suspension has been revoked vide impugned order dated 24/04/2026 (Annexure P-1) in compliance with the order passed by this Court in WPS No.3515/2026. However, while revoking the suspension, the petitioner has been posted at Mungeli though her original posting was at Korba. Learned counsel further submits that earlier vide order dated 09/10/2023, the petitioner was transferred from Korba to Mungeli, but the said transfer order was already quashed by this Court vide order dated 01/09/2025 passed in WPS No.8902/2023. Despite the same, by referring to the aforesaid transfer order dated 09/10/2023, which no longer survives in the eyes of law, the petitioner has again been posted at Mungeli. 3. Per contra, learned counsel appearing for the State opposes the submissions made by the petitioner and submits that the order dated 24/04/2026 is not a transfer order simpliciter, but an order passed for the purpose of proper conduct of departmental enquiry while revoking the suspension of the petitioner. 4. I have heard learned counsel for the parties and perused the documents appended with the writ petition. 3 5. From perusal of the impugned order dated 24/04/2026, it appears that though the suspension of the petitioner has been revoked, while posting her at Mungeli, reliance has been placed upon the earlier transfer order dated 09/10/2023 whereby the petitioner was transferred from Korba to Mungeli. It is not in dispute that the aforesaid transfer order dated 09/10/2023 has already been quashed by this Court vide order dated 01/09/2025 passed in WPS No.8902/2023. 6. Once the aforesaid transfer order dated 09/10/2023 stood quashed by this Court, the respondent authorities could not have relied upon the same while passing the impugned order dated 24/04/2026 for posting the petitioner at Mungeli. Therefore, insofar as the impugned order dated 24/04/2026 posts the petitioner at Mungeli on the basis of the already quashed transfer order, the same is not sustainable in the eyes of law and deserves to be quashed. 7. Accordingly, the impugned order dated 24/04/2026 (Annexure P- 1) passed by respondent No.3, to the extent it posts the petitioner at Mungeli, is hereby quashed.
