The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 129/2026, registered at Police Station – Torwa, District – Bilaspur (C.G.) for the offence punishable under Sections 296, 115(2), 351(3), 119(1) and 3(5) of BNS. 2. It has been brought to the notice of this Court by the learned State counsel that the charge-sheet has been filed against the applicant and the co-accused on 14.04.2026, wherein the offence under Section 109 of the BNS has been newly added, and one of the co-accused namley Sumit Singh had filed MCRC No.4365/2026, and the same also dismissed as withdrawn on 12.05.2026. Learned counsel for the applicant submits prays that he may be permitted to withdraw the present bail application with liberty to the applicant to file afresh, as the offence under Section 109 of the BNS has also been added after filing of the charge-sheet. 4. Learned State counsel has no objection. 5. Permission is granted. 6. In view of the above, the instant petition is dismissed as withdrawn with liberty to the applicant to file afresh.
