The case of the prosecution, is that a report was made by Pareshwar Dewangan that he along with others on the allurement made by the persons of K.M.J. Land Developers India Ltd. had deposited certain amounts in the said company with an assurance of returning the deposits with high returns. However subsequently the Company was closed and the amounts of the depositors including that of the complainant were not returned. 2 that the money was circulated without permission of the RBI or SEBI, thereby the offence has been committed. On the basis of aforesaid story of the prosecution, the crime was registered against the applicant and the co-accused person. Hence, this application. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case and there are 25 criminal antecedents of the applicant out of which in 20 cases the applicant is on bail. It is further submitted that the applicant is in jail since 28.02.2026 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 4.
On the other hand, the learned State counsel opposes the bail application and submits that there are 25 criminal antecedents of the applicant, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that there are 25 criminal antecedents of the applicant out of which in 20 cases the applicant is on bail, the applicant is in jail since 28.02.2026 and conclusion of the trial is likely to take some time, I am inclined to allow this application. 7.
