02/08.07.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Kuru P.S. Case No. 08 of 2025, registered for the offence under Sections 351(3), 61, 109 and 3(5) of Bhartiya Nyaya Sanhita, 2023 and Sections 25(1-B) a, 27 and 35 of the Arms Act, pending in the court of learned Judicial Magistrate, 1st Class, Lohardaga.

Learned counsel appearing for the petitioner submits that the petitioner has earlier moved before this court in A.B.A. No.4165 of 2025 which was dismissed as withdrawn by order dated 07.08.2025. He next submits that thereafter the petitioner has filed A.B.A. No.7542 of 2025 which was also dismissed as withdrawn with the liberty to the petitioner to move before the learned Sessions Judge on the fresh ground. He next submits that on the fresh ground, the petitioner has moved before the learned Sessions Judge however, the same was rejected. He also submits that one of the co-accused has been granted anticipatory bail and in view of that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that there is no fresh ground and the co-accused has been granted anticipatory bail by order dated 20.12.2025, wherein the petitioner has withdrawn the first anticipatory bail application on 07.08.2025 that is later on.

Considering that the ground which has been taken for filing the third anticipatory bail application, was already there when the first anticipatory bail application was withdrawn and subsequently, second anticipatory bail application was also dismissed as withdrawn and this is third anticipatory bail application, in the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the prayer of anticipatory bail of the petitioner, is hereby, rejected.
