PIN CODE 518405. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 7 on the basis of report given by the Respondent No.5 dated 07-10-2025 to the petitioner and not followed the report dated 07-10-2025 is illegal, arbitrary and voilative of Article 300-A of Constitution of India. IA No.1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents 2 to 7 to remove the encroachments in main kaluva and panta kaluva in Survey Number 132/B and 132/C situated in Chinthalapalli Village, Midthur Mandal, Nandyala District, immediately and to take water from the main kaluva and panta kaluva to the land of the petitioner, pending disposal of the writ petition. GP FOR IRRIGATION COMM AREA DEV The Court made the following 3 ORDER: The petitioner is an agriculturist having an extent of Ac.4-80 cents in Survey No.133 and an extent of Ac.3-74 cents in Survey No.131-A3 of Chinthalapalli Village, Midthur Mandal and Nandyala District. When the respondent Nos.8 and 9 have illegally encroached the main canal and irrigation canal of Narapalle pond, objecting flow of water to the petitioner’s lands for cultivation, the petitioner made a representation on 21.07.2025 to the 2nd respondent - for removal of the encroachments. The 3rd respondent – Superintending Engineer, Nandyal gave directions to the 4th respondent – Assistant Executive Engineer, Nandikotkur and, on his direction, the 5th respondent – The Tahsildar, Midthur Mandal, furnished a report, dated 07.10.2025, to the petitioner, which reveals the encroachment of main canal and irrigation canal and there is standing crop in Survey Nos.132/B and 132/C No.3 of Chinthalapalli Village and when once the crop is harvested, the encroachments would be removed but the respondents did not take any action thereafter. Hence, the present Writ Petition. 2. Learned Assistant Government Pleader for Revenue, appearing on behalf of the official respondents, on the written instructions, dated 05.05.2026, submits that the respondents have already identified the encroachments, issued notices to the petitioner as well as the un-official respondents and are taking steps for removal encroachments, strictly in accordance with law. 3. Recording the aforesaid submission of learned Assistant Government Pleader for Revenue, without delving into the merits of 4 the case, this Court deems it appropriate to dispose of the Writ Petition by directing the respondents to issue notices to the petitioner as well as un-official respondents for demarcation of the lands in subject, within ten (10) days from the date of receipt of a copy of this order, and after giving an opportunity of hearing to both the parties, conduct an enquiry in their presence, and shall take appropriate action for removal of the encroachments within three (3) months thereafter. 4. Accordingly, with the above direction, the Writ Petition stands disposed of. No order as to costs.
