. Item No. S-5 Court on its own motion Vs. State of Himachal Pradesh and others. CMPs No. 20157 and 20172 of 2026 in CWPIL No. 31 of 2022. 07.08.2026 Present: M/s Rakesh Kumar Thakur and Ranjana Sharma, Advocates, for the applicant/proposed respondent. Mr. Nimish Gupta, Advocate, as Amicus Curiae. Mr. Arsh Rattan, Deputy Advocate General, for non- applicants/respondents No.1 to 5-State. Mr. Shivom Vashista, Advocate, for Mr. Adarsh Kumar Vashista, Advocate, for non-applicant/respondent No.6. CMP No. 20157 and 20172 of 2026 CMP No. 20157 of 2026 has been filed for impleading the applicant i.e. M/s Prince Trading Co., as respondent-party and CMP No. 20172 of 2026 has been filed for extension of time to continue running the allotted shops from 07.08.2026 to 13.08.2026, in Minjar Fair at Chamba, H.P. 2. A perusal of the annexures would go on to show that the applicant with open eyes had applied for the tender, which was from 26.07.2026 to 09.08.2026, given by the Fair Minjar Committee and paid the necessary upfront money. Resultantly, there is no vested right as such to continue beyond the period, since it is a contractual right. 3. In similar circumstances, even last year, applications had been filed i.e. CMPs No. 18879 and 18891 of 2025, in which we had expressed our doubt as such, as there was a commercial interest of the applicants and therefore, the period of stay could not be extended by virtue of the judicial orders. Said applications were accordingly dismissed as not pressed, vide order dated 08.08.2025. 4. Keeping in view the above, we do not find any plausible reason to take a different view now. Accordingly, the present applications are dismissed. 5. Applications stand disposed of accordingly. (G.S. Sandhawalia) Chief Justice ( Jiya Lal Bhardwaj ) Judge August 07, 2026 (Shivank Thakur)
