This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 61/2026 registered at Police Station – Sarangarh, District - Sarangarh-Bilaigarh (C.G.) for the offence punishable under Sections 04, 05 and10 of Chhattisgarh Agricultural Cattle Preservation Act, 2004. 2. The prosecution case, in a nutshell, is that the concerned police authorities received information from an informant that, on the date of the incident, the accused persons were in possession of the illegal skin of an animal. Acting upon the said information, the police conducted a search and allegedly seized 15 kilograms of raw flesh of a cow from the possession of the accused persons. Consequently, the police registered PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.13 14:59:27 +0530 2 the aforesaid offence under Sections 4, 5, and 10 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004 against the accused persons. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the applicant has no previous criminal antecedents. He also submits that the co-accused persons, namely, Janaki has been granted bail by this Court vide order dated 08.04.2026 passed in MCRCA No. 509/2026, copy of the same has been annexed as Annexure A/3 of this bail application. Further the applicant has no previous criminal antecedents. Therefore, he prays grant of bail to the applicant on the ground of parity. 4. On the other hand, the learned State counsel opposes the bail application of the applicant but could not dispute the fact that the co-accused persons has already been granted anticipatory bail by this Court and the case of the present applicant is identical to that of the co-accused persons. She also submits that the applicant has two previous criminal antecedents under the IPC of the year 2018 and 2021, hence, the applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicant and the fact that the the co-accused persons, namely, Janaki has been granted bail by this Court vide order dated 08.04.2026 passed in MCRCA No. 509/2026, copy of the same has been annexed as Annexure A/3 of this bail application, further the applicant has two previous criminal antecedents under the IPC of the year 2018 and 2021, which are old and stale, hence, this Court is of the view that the applicant is entitled to be granted 3 anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Kanhaiya Satnami on executing a personal bond with one local surety each in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
