JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioner filed this writ petition seeking the following reliefs: “1. Direct the 2nd and 3rd Respondent for issurance of direction to 4th Respondent management to complete the disciplinary proceedings which was proposed as per the suspension order dated 03/05/2010 vide Annexure-A. - 3 - HC-KAR NC: 2026:KHC:25872 WP No. 235 of 2017 2. And further direct the 4th Respondent to pay the subsistence allowance as per the rules. 3. And grant any such other relief that this Hon’ble court deems fit to grant in the interest of justice and equity.” 2. Brief facts leading rise to the filing of this petition are as follows: 2.1. The petitioner was appointed as a Physical Education Teacher in the school run by respondent No.4 in 2007 and he was kept under suspension on 03.05.2010. The petitioner made a representation to respondent Nos.1 to 3 to direct respondent No.4 to pay the subsistence allowance. Respondent No.3 issued an endorsement to approach respondent No.4. It is contented that, respondent No.4 initiated disciplinary proceedings against the petitioner. It is contented that, respondent No.4 has not yet completed the disciplinary proceedings. Hence, the petitioner has filed this writ petition seeking direction to respondent Nos.2 and 3 to direct respondent No.4 to complete the disciplinary proceedings which was proposed as per the suspension order - 4 - HC-KAR NC: 2026:KHC:25872 WP No. 235 of 2017 dated 03.05.2010 vide Annexure-A and also a direction to respondent No.4 to pay the subsistence allowances as per the rules. 3. Learned counsel for respondent No.4 submits that, the enquiry has been concluded, an order of punishment was passed and the same was intimated to the petitioner. He submits that, as the enquiry has already been concluded and an order of punishment has already been passed, in view of the same, nothing further survives for consideration in this writ petition. 4. Accordingly, the writ petition is disposed of as having rendered infructuous. 5. In view of disposal of the petition, pending IA(s), if any, shall stand disposed of.
