Rinku v. State of Himachal Pradesh Cr. MP (M) No.1577 of 2026 20.08.2026. Present: Mr. Somesh Sharma, Advocate, for the appellant. Mr. Raj Negi, Deputy Advocate General, for the respondent. Cr. MP (M) No.1577 of 2026 Notice. Mr. Raj Negi, learned Deputy Advocate General, accepts and waives service of notice on behalf of the respondent. By way of this application filed under Section 5 of the Limitation Act read with Section 528 of the BNSS, a prayer has been made by the applicant for condonation of 234 days delay in filing the appeal. Learned counsel for the applicant has taken the Court through paragraphs No.3 and 4 of the application and submitted that the reasons spelt out therein have led led to the delay in filing the appeal. He submitted that the delay in filing the appeal is bona fide and not intentional and it would be in the interest of justice in case the delay is condoned, so that the applicant gets an opportunity to assail the judgment of conviction on merit. Though, learned Deputy Advocate General has opposed the application, but we are of the considered view that as the delay in filing the appeal has been satisfactorily explained, it would be in the interest of justice to give an opportunity to the applicant to assail the judgment of conviction on merit. Accordingly, the application is allowed and delay of 234 days in filing the appeal is condoned. Application stands disposed of. Cr. Appeal No. _______ of 2026 Be registered. Admit. Post Admission Notice. Mr. Raj Negi, learned Deputy Advocate General, accepts and waives service of post admission notice on behalf of the respondent. As prayed for, list for hearing before the appropriate Bench immediately after the record is received. (Ajay Mohan Goel) Judge (Ranjan Sharma) August 20, 2026 Judge [Shivender/Ritu]
