For Non-applicant/State : Mr. Sourabh Sahu, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 15.05.2026 1. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No. 11/2026 registered at Police Station – Narayanpur, District- Jashpur (C.G.) for the offence punishable under Sections 4, 6 and 10 of Chhattisgarh Pashu Pariraksahn Adhiniyam. 2. As per the prosecution case, on 02.02.2026 at about 3:00 a.m., the police received information from an informant that certain individuals were transporting 32 cattle towards a slaughterhouse in Jharkhand via PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.15 18:09:03 +0530 2 Bachhraon and were allegedly beating the cattle with sticks during transit. It is alleged that the applicants, along with other persons, had agreed to pay Rs. 1,000/- each for transporting the cattle from Kajra Dhongaghat to Beltol. Acting upon the said information, the police intercepted and seized the cattle from the possession of the co-accused persons. During the course of investigation, the present applicants were also implicated in the matter, and accordingly, a case/crime was registered against the applicants and other accused persons for the aforesaid offences. 3. It has been argued by learned counsel for the applicants that the applicants are innocent and have been falsely implicated in the present case. It is submitted that the applicants have been arrayed as accused merely on the basis of suspicion, whereas they were not present at the place of occurrence at the relevant time. It is further submitted that the co-accused, namely, Mohd. Masud Ansari, has already been granted anticipatory bail by this Court vide order dated 02.04.2026 passed in MCRCA No. 513/2026. It is also submitted that the applicants have no previous criminal antecedents. Therefore, learned counsel prays that the applicants be granted bail on the ground of parity. 4. On the other hand, the learned State counsel opposes the bail application of the applicants but could not dispute the fact that the co-accused person has already been granted bail by this Court and the case of the present applicants is identical to that of the co-accused person. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicants and the fact that the the co-accused person, namely, Mohd. Masud Ansari has already been granted anticipatory bail by this Court vide order dated 02.04.2026 3 passed in MCRCA No. 513/2026 and further the applicants have no previous criminal antecedents, hence, this Court is of the view that the applicants are entitled to be granted anticipatory bail in this case. 7.
