The applicant has preferred this third bail application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he is in custody in connection with crime No. 351 of 2022 registered in Police Station - Pulgaon, District - Durg, C.G. for offence punishable under Sections 294, 307 of IPC and Section 25 (1-Kha) (Kha) of the Arms Act. 4. The First bail application of the applicant was dismissed on merits on 03.07.2023 in MCRC No. 3183/2023 and the Second bail application was also dismissed on merits on 01.05.2025 in MCRC No. 3382/2025. 5. Case of the prosecution in brief is that on 19.08.2022 at about 6:15 p.m., the complainant’s son Nitesh Bafna came home in injured condition with bleeding from his abdomen and informed the complainant that while he was standing behind the waiting hall, the main accused Abhishek Yadav (the present applicant) inflicted a knife blow on his abdomen with a sharp-edged weapon, whereas the other co-accused persons caught hold of him. It is further alleged that all the accused persons jointly hurled abuses at him on account of a dispute between them. 6. Learned counsel for the applicant submits that the earlier bail applications were dismissed on merits, however, the present application is the third bail application and has been filed solely on the ground of delay in conclusion of the trial. She submits that although 14 witnesses have been cited in the charge-sheet, two of them have been given up by the prosecution. Out of the remaining 12 witnesses, only 6 witnesses have been examined so far and the doctor who treated the injured has not been examined before the learned Trial Court for almost one and a half years. She further submits that the other co-accused persons were granted bail by this Court vide order dated 14.12.2022 passed in MCRC No. 9739/2022. It is also submitted that the applicant has been in judicial custody since 19.08.2022 and has already undergone more than 3 years and 6 months of incarceration as an under-trial prisoner. Therefore, it is prayed that the applicant may be enlarged on bail. 3
7.
On the other hand, learned counsel for the State opposes the bail application and submits that the earlier two bail applications were dismissed on merits and, therefore, no sufficient ground exists for allowing the present application. 8. I have heard learned counsel for the parties and perused the case diary. 9. Considering the facts and circumstances of the case, considering the rival
submissions made by counsel for parties, looking to the detention period, material available on record and the trial has not concluded as yet, therefore, I am inclined to allow this bail application.
10. Accordingly, the bail application filed by applicant is allowed and it is
directed that applicant shall be released on bail on furnishing a personal bond in the sum of Rs. 25,000/- with one solvent surety for the like amount to the satisfaction of the court concerned with the following conditions:- (a) He shall appear before the trial Court regularly on each and every date, unless exempted from appearance. b) He shall not make any attempt to tamper with the prosecution witnesses. c) He shall not leave the State of Chhattisgarh without the permission of the learned trial Court. If any of the conditions is violated by the applicant, learned trial Court is at liberty to cancel the bail granted to the applicant. Certified copy as per rules. Sd/-
